1Koşulların Kabulü

ULAŞSANA mobil uygulamasını ("Uygulama") indirerek, yükleyerek veya kullanarak bu Kullanım Koşulları'nı ("Koşullar") kabul etmiş olursunuz. Bu Koşullar'ın herhangi bir kısmını kabul etmiyorsanız, Uygulamayı kullanmamalısınız.

Bu Koşullar, sizinle ULAŞSANA BİLİŞİM VE TAŞIMACILIK HİZMETLERİ A.Ş. ("Şirket", "biz") arasında hukuken bağlayıcı bir sözleşme teşkil eder.

2Hizmet Tanımı

ULAŞSANA, ulaşım hizmeti talep eden müşteriler ile uygun şoförleri dijital ortamda eşleştiren bir matchmaking platformudur.

Şirket:

• Şoförleri istihdam etmez veya sözleşme yapmaz
• Araç sahibi değildir ve araç işletmez
• Fiyatları belirlemez veya kontrol etmez
• Ödeme tahsil etmez veya işlemez
• Mali işlemlere aracılık etmez

3Kullanıcı Hesapları

Uygulamayı kullanmak için bir hesap oluşturmalı ve doğru bilgi sağlamalısınız. Aşağıdakilerden sorumlusunuz:

• Hesabınızın gizliliğini korumak
• Hesabınız altında gerçekleşen tüm faaliyetler
• Yetkisiz kullanım durumunda bizi derhal bilgilendirmek

Hesap oluşturmak ve Uygulamayı kullanmak için en az 18 yaşında olmalısınız.

4Kullanıcı Yükümlülükleri

Uygulamayı kullanarak aşağıdakileri kabul edersiniz:

• Doğru ve güncel bilgi sağlamak
• Uygulamayı yalnızca yasal amaçlarla kullanmak
• Hizmeti kötüye kullanmamak, aksatmamak veya müdahale etmemek
• Uygulamanın herhangi bir bölümüne yetkisiz erişim sağlamaya çalışmamak
• Diğer kullanıcılara (şoförler/müşteriler) saygılı davranmak
• Uygulamayı dolandırıcılık veya yasa dışı faaliyetler için kullanmamak

5Ödeme & Mali Koşullar

ULAŞSANA herhangi bir ödemeyi işlemez, tahsil etmez veya aracılık etmez.

• Tüm ödeme düzenlemeleri doğrudan müşteri ile şoför arasında yapılır
• Şirket, ödeme anlaşmazlıklarından sorumlu değildir
• IBAN bilgisi, yalnızca şoförün nakitsiz ödemeyi tercih etmesi halinde müşteriyle paylaşılır

6Sorumluluk Sınırı

Yasaların izin verdiği azami ölçüde:

• ULAŞSANA, şoförler tarafından sunulan taşıma hizmetlerinin kalitesi, güvenliği veya yasallığından sorumlu değildir
• Müşteriler ile şoförler arasındaki anlaşmazlıklardan sorumlu değiliz
• Uygulamanın kullanımından kaynaklanan doğrudan, dolaylı, arızi veya sonuç olarak ortaya çıkan zararlardan sorumlu değiliz
• Uygulama, hiçbir garanti verilmeksizin "OLDUĞU GİBİ" sunulmaktadır

7Hesap Silme

Hesabınızı ve hesabınızla ilişkili tüm verileri istediğiniz zaman silebilirsiniz.

8Fikri Mülkiyet

ULAŞSANA ile ilişkili tüm içerik, tasarım, logolar, ticari markalar ve yazılımlar Şirketin münhasır mülkiyetindedir. Önceden yazılı izin alınmadan Uygulamanın herhangi bir bölümünü kopyalayamaz, değiştiremez, dağıtamaz veya tersine mühendislik yapılamaz.

9Fesih

Aşağıdaki durumlarda hesabınızı askıya alma veya sonlandırma hakkımız saklıdır:

• Bu Koşullar'ın herhangi birini ihlal etmeniz
• Dolandırıcılık, istismar veya yasa dışı faaliyetlerde bulunmanız
• Hesabınızın diğer kullanıcılar veya platform için risk oluşturması

Siz de istediğiniz zaman hesabınızı uygulama üzerinden silerek sonlandırabilirsiniz.

10Uygulanacak Hukuk

Bu Koşullar, Türkiye Cumhuriyeti kanunlarına tabidir ve bu kanunlara uygun olarak yorumlanır. Bu Koşullar'dan doğan anlaşmazlıklarda İstanbul Mahkemeleri ve İcra Daireleri yetkilidir.

11Koşul Değişiklikleri

Bu Koşullar'ı zaman zaman güncelleyebiliriz. Değişiklikler Uygulama içinde ve bu sayfada yayımlanacaktır. Değişikliklerden sonra Uygulamayı kullanmaya devam etmeniz, yeni Koşullar'ı kabul ettiğiniz anlamına gelir.

12Çökme Raporlama

Uygulama kararlılığını artırmak amacıyla Sentry hizmeti kullanılmaktadır.

• Yalnızca anonim hata ve çökme verileri toplanır
• Toplanan veriler: cihaz türü, işletim sistemi sürümü, uygulama sürümü ve hata kayıtları
• Kişisel tanımlayıcı bilgi (ad, e-posta, konum, telefon) kesinlikle gönderilmez
• Bu veriler yalnızca uygulama geliştirme ve hata düzeltme amacıyla kullanılır

1Acceptance of Terms

By downloading, installing, or using the ULAŞSANA mobile application ("Application"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the Application.

These Terms constitute a legally binding agreement between you and ULAŞSANA BİLİŞİM VE TAŞIMACILIK HİZMETLERİ A.Ş. ("Company", "we", "us").

2Service Description

ULAŞSANA is a matchmaking platform that connects customers who need transportation with available drivers through a digital interface.

The Company:

• Does not employ or contract the drivers
• Does not own or operate any vehicles
• Does not set or control pricing
• Does not collect or process payments
• Does not mediate financial transactions

3User Accounts

To use the Application, you must create an account and provide accurate information. You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

You must be at least 18 years old to create an account and use the Application.

4User Obligations

By using the Application, you agree to:

• Provide accurate and up-to-date information
• Use the Application only for lawful purposes
• Not misuse, disrupt, or interfere with the service
• Not attempt to gain unauthorized access to any part of the Application
• Treat other users (drivers/customers) with respect
• Not use the Application for any fraudulent or illegal activity

5Payments & Financial Terms

ULAŞSANA does not handle, process, or mediate payments of any kind.

• All payment arrangements are made directly between the customer and the driver
• The Company is not responsible for any payment disputes
• IBAN information may be shared with the customer only if the driver opts for cashless payment

6Limitation of Liability

To the maximum extent permitted by law:

• ULAŞSANA is not liable for the quality, safety, or legality of transportation services provided by drivers
• We are not responsible for any disputes between customers and drivers
• We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Application
• The Application is provided "AS IS" without warranties of any kind

7Account Deletion

You may delete your account and all associated data at any time.

8Intellectual Property

All content, design, logos, trademarks, and software associated with ULAŞSANA are the exclusive property of the Company. You may not copy, modify, distribute, or reverse-engineer any part of the Application without prior written consent.

9Termination

We reserve the right to suspend or terminate your account if:

• You violate any of these Terms
• You engage in fraudulent, abusive, or illegal activity
• Your account poses a risk to other users or the platform

You may also terminate your account at any time by deleting it through the app.

10Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes shall be subject to the exclusive jurisdiction of the Istanbul Courts and Enforcement Offices.

11Changes to Terms

We may update these Terms from time to time. Changes will be posted within the Application and on this page. Your continued use of the Application after any changes constitutes acceptance of the new Terms.

12Crash Reporting

We use Sentry to improve app stability and diagnose issues.

• Only anonymous crash and error data is collected
• Data collected includes: device type, OS version, app version, and error stack traces
• No personally identifiable information (name, email, location, phone) is ever sent
• This data is used solely for app development and bug fixing purposes
